These Terms of Service ("Terms") govern your access to and use of Tap2Check-In, including our websites, check-in pages, review request tools, customer engagement tools, appointment tools, loyalty tools, SMS, MMS, email, posting, digital marketing, automation tools, and related services (collectively, the "Services").

Tap2Check-In is operated by Loa Keo LLC ("Loa Keo," "Tap2Check-In," "we," "us," or "our").

If you do not agree, do not use the Services.

1. Description of Services

Tap2Check-In provides customer check-in, customer engagement, review request, appointment communication, loyalty, promotional messaging, SMS, MMS, email, posting, digital marketing, and automation tools for participating businesses, including salons, spas, beauty businesses, service providers, and other merchants.

Participating businesses use Tap2Check-In to collect customer information, manage check-ins, request feedback or reviews, send appointment-related messages, send loyalty and promotional messages, and communicate with customers through SMS, MMS, email, and other digital channels.

2. Parties and Roles

Loa Keo LLC operates Tap2Check-In as a technology and marketing services provider.

Participating businesses are independent merchants that use Tap2Check-In to communicate with their own customers. Tap2Check-In may send messages on behalf of those participating businesses.

Customers are individuals who provide information, check in, book appointments, request services, opt in to communications, or otherwise interact with a participating business through Tap2Check-In.

3. Business Account Responsibilities

If you use Tap2Check-In as a participating business, you are responsible for:

  • providing accurate business information;
  • ensuring you have the legal right to contact your customers;
  • ensuring all customer data you submit or collect is accurate and lawfully obtained;
  • honoring customer opt-out requests;
  • using Tap2Check-In only for lawful purposes;
  • not uploading purchased, rented, scraped, harvested, or third-party lead lists;
  • not sending unlawful, deceptive, abusive, harassing, fraudulent, or prohibited content;
  • complying with applicable laws, rules, carrier requirements, platform policies, and industry guidelines.

You are responsible for the content of messages sent on your behalf through Tap2Check-In.

4. Customer Information

Customers may provide information such as name, phone number, email address, birthday, visit history, appointment details, preferences, feedback, and other information related to their interaction with a participating business.

By submitting information through Tap2Check-In, customers authorize Tap2Check-In and the participating business to process that information for the purposes described in these Terms and our Privacy Policy.

5. SMS and Mobile Messaging Terms

Tap2Check-In provides SMS and mobile messaging services on behalf of participating businesses. Messages may include transactional, informational, promotional, and customer engagement communications.

Message types may include:

  • check-in confirmations;
  • review or feedback requests;
  • appointment confirmations;
  • appointment reminders;
  • appointment updates;
  • cancellation notices;
  • loyalty reminders;
  • rewards messages;
  • birthday offers;
  • holiday messages;
  • win-back reminders;
  • appointment offers;
  • discounts;
  • promotions;
  • customer satisfaction messages;
  • business updates;
  • other messages related to the participating business.

Message frequency varies based on the participating business, customer activity, automation settings, appointment activity, loyalty status, and marketing preferences.

Message and data rates may apply.

Consent to receive marketing text messages is not a condition of purchase.

6. Express Written Consent for Marketing Messages

By providing your phone number and affirmatively checking the SMS consent box, submitting an opt-in form, texting an opt-in keyword, or otherwise providing consent through an approved Tap2Check-In opt-in method, you provide express written consent to receive recurring automated text messages from the participating business via Tap2Check-In, operated by Loa Keo LLC.

Messages may be sent using automated technology, including an automatic telephone dialing system or similar messaging technology, where applicable.

Messages may include check-in confirmations, review requests, feedback requests, appointment messages, loyalty reminders, rewards, promotions, appointment offers, discounts, birthday offers, holiday messages, win-back reminders, and other customer engagement messages.

Consent to receive marketing text messages is not required to make a purchase or receive services from the participating business.

7. SMS Consent Requirements

When a customer provides a phone number and checks the SMS consent box, the customer agrees to receive recurring automated text messages from the participating business via Tap2Check-In, operated by Loa Keo LLC.

Customers may consent to different categories of messages, including transactional messages, booking reminders, promotional messages, loyalty messages, and marketing messages.

For promotional or marketing messages, customers must provide express written consent through an affirmative action such as checking a consent box, submitting a form, texting a keyword, or another approved opt-in method.

The consent request must clearly identify the participating business, Tap2Check-In, the message types, message frequency disclosure, message and data rate disclosure, opt-out instructions, help instructions, and links to these Terms and our Privacy Policy.

8. SMS Keywords

Where supported by the applicable sender, number, short code, or messaging provider:

  • Text START, SUBSCRIBE, YES, or UNSTOP to opt in or re-subscribe.
  • Text STOP, END, CANCEL, UNSUBSCRIBE, QUIT, STOPALL, OPTOUT, or REVOKE to opt out.
  • Text HELP or INFO for help or program information.

Some sender types do not support replies. If a message is sent from a sender that does not accept replies, the message will provide another opt-out method, such as texting STOP to a designated opt-out number or contacting support.

9. SMS Opt-Out and HELP

Customers may opt out of SMS messages at any time by following the opt-out instructions in the message.

Where replies are supported, customers may reply STOP to opt out and HELP for help.

If messages are sent from a sender that does not support replies, the message will provide an alternative opt-out method, such as texting STOP to a designated opt-out number or contacting support.

After a customer opts out, Tap2Check-In and/or the participating business will take reasonable steps to stop sending marketing SMS to that customer, except where legally permitted for necessary transactional, administrative, legal, security, support, or appointment-related communications.

10. Message Frequency

Message frequency varies by participating business, customer activity, appointment activity, loyalty status, campaign settings, and customer preferences.

Unless otherwise disclosed in a specific campaign, customers may receive recurring messages. Certain transactional messages, such as appointment confirmations, appointment reminders, cancellation notices, or service-related messages, may be sent in addition to marketing messages where permitted.

11. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Message delivery is subject to carrier networks, filtering, routing, registration status, sender verification, device availability, customer device settings, and other factors outside our control.

Participating carriers may vary.

12. ClickSend, Twilio, and Messaging Providers

Tap2Check-In may use third-party communication providers, including SMS gateways, messaging platforms, carriers, aggregators, email providers, and communications APIs, to send and manage messages.

These providers may include ClickSend, Twilio, or similar services.

Messaging availability, delivery, sender registration, 10DLC approval, toll-free verification, short code approval, opt-out handling, and carrier filtering may be controlled by third-party providers and carriers.

13. 10DLC, Toll-Free, Short Code, and Sender Registration

For US and Canada messaging, certain message types may require registered sender infrastructure, such as 10DLC, toll-free verification, short code registration, campaign registration, brand registration, or other approval processes.

Participating businesses must provide accurate information needed for sender registration and campaign approval.

Tap2Check-In may suspend or restrict SMS sending if sender registration, campaign approval, consent records, opt-out handling, or message content does not meet applicable requirements.

14. Canada Mobile Messaging

If Tap2Check-In supports messaging to Canadian recipients, additional consent, sender, and confirmation requirements may apply. Depending on the sender type and campaign, customers may be required to confirm their subscription by replying YES, SUBSCRIBE, or another approved confirmation keyword before receiving recurring marketing messages.

Canadian customers may opt out by replying STOP or another supported opt-out keyword where replies are supported. Message frequency varies. Message and data rates may apply.

15. Prohibited Messaging

You may not use Tap2Check-In to send messages that contain or promote:

  • illegal products or services;
  • deceptive, misleading, or fraudulent claims;
  • harassment, hate, threats, or abusive content;
  • phishing, malware, or suspicious links;
  • high-risk financial products without approval;
  • controlled substances, illegal drugs, or prohibited health claims;
  • adult content where prohibited;
  • gambling where prohibited;
  • content involving sex, hate, alcohol, firearms, or tobacco where prohibited or not properly approved;
  • any content prohibited by law, carriers, ClickSend, Twilio, or other messaging providers.

16. Anti-Abuse, Security, and No Spam

You may not use Tap2Check-In to:

  • send spam or unwanted messages;
  • bypass consent or opt-out rules;
  • harvest, scrape, buy, rent, or misuse contact lists;
  • interfere with the Services;
  • attempt unauthorized access;
  • introduce malware or harmful code;
  • reverse engineer the Services;
  • damage Tap2Check-In, Loa Keo LLC, participating businesses, customers, messaging providers, or carrier networks.

17. Reviews, Feedback, and Public Posting

Tap2Check-In may help participating businesses request customer feedback or reviews.

Participating businesses are responsible for ensuring their review request practices comply with applicable platform policies, consumer protection laws, advertising laws, and review platform rules.

You may not use Tap2Check-In to submit fake reviews, suppress negative reviews unlawfully, misrepresent customer opinions, incentivize reviews unlawfully, or post content without appropriate authorization.

18. Rewards, Discounts, Offers, and Redemptions

Rewards, discounts, birthday treats, loyalty benefits, appointment offers, promotions, pricing, eligibility rules, expiration dates, exclusions, and redemption terms are set by the participating business, not Tap2Check-In, unless expressly stated otherwise.

Participating businesses are responsible for honoring their own offers and for ensuring that offer terms are accurate, lawful, not misleading, and clearly disclosed to customers.

Tap2Check-In is not responsible for disputes between customers and participating businesses regarding reward eligibility, offer availability, pricing, expiration, exclusions, or redemption.

19. Email Communications

Tap2Check-In may send email messages on behalf of participating businesses, including appointment messages, review requests, loyalty messages, promotional offers, business updates, and service communications.

Participating businesses are responsible for ensuring that email communications comply with applicable laws, including unsubscribe and sender identification requirements.

20. Digital Marketing and Posting Services

If Tap2Check-In provides social media, digital marketing, posting, campaign, or advertising services, participating businesses authorize Tap2Check-In to create, schedule, publish, manage, or assist with content according to the agreed service scope.

Participating businesses are responsible for ensuring that offers, pricing, promotions, images, claims, and content provided to Tap2Check-In are accurate and lawful.

21. Third-Party Websites, Review Platforms, Booking Links, and Social Media

The Services may contain links to third-party websites, review platforms, booking pages, maps, social media pages, payment pages, or participating business websites. Those third parties have their own terms and privacy practices.

Tap2Check-In is not responsible for the privacy, security, content, availability, or practices of third-party websites or platforms.

22. Customer Opt-Out Records

Tap2Check-In may maintain opt-out, suppression, consent, and preference records to help comply with messaging laws and provider requirements.

Participating businesses must not attempt to bypass opt-out records or re-upload opted-out contacts for marketing messages without valid renewed consent.

23. Data Accuracy

Participating businesses and customers are responsible for providing accurate contact information.

Tap2Check-In is not responsible for messages sent to incorrect phone numbers or email addresses if inaccurate information was provided by a user, customer, or participating business.

24. Fees and Payment

Participating businesses must pay all fees associated with their Tap2Check-In account or service plan.

Additional charges may apply for SMS, MMS, email, automation, digital marketing, setup, registration, carrier fees, 10DLC fees, toll-free verification, campaign approval, number rental, usage, overages, or premium services.

Fees are subject to change with notice where required.

25. Suspension and Termination

Tap2Check-In may suspend or terminate access to the Services if:

  • you violate these Terms;
  • you send prohibited or non-compliant messages;
  • you fail to pay fees;
  • your use creates legal, carrier, deliverability, security, or reputation risk;
  • a messaging provider, carrier, regulator, or platform requires suspension;
  • your sender registration or campaign approval is rejected, suspended, or revoked.

26. No Guaranteed Delivery

Tap2Check-In does not guarantee that SMS, MMS, email, or other messages will be delivered, opened, read, clicked, or acted upon.

Delivery may be affected by carrier filtering, spam filtering, network conditions, device settings, blocked numbers, invalid contact information, third-party provider issues, customer opt-outs, and other factors.

27. Intellectual Property

Tap2Check-In, including its name, branding, software, workflows, templates, designs, content, technology, and documentation, is owned by Loa Keo LLC or its licensors.

You may not copy, modify, reverse engineer, resell, or misuse the Services except as expressly permitted in writing.

28. No Resale or Competing Use

You may not resell, sublicense, white-label, rent, lease, commercially exploit, or use the Services to build a competing product or service unless expressly authorized in writing by Loa Keo LLC.

29. Customer Content

Participating businesses retain ownership of business content, customer lists, logos, offers, images, promotions, and other materials they submit.

By submitting content to Tap2Check-In, you grant Loa Keo LLC a license to use, host, process, display, send, publish, and distribute that content as necessary to provide the Services.

By using Tap2Check-In, you agree to our Privacy Policy.

31. No Legal Advice

Tap2Check-In may provide templates, suggested wording, compliance tools, and messaging guidance. These materials are provided for informational purposes only and are not legal advice.

Participating businesses are responsible for obtaining their own legal advice regarding SMS marketing, privacy, advertising, consumer protection, TCPA, CTIA, CAN-SPAM, state laws, and other applicable requirements.

32. Disclaimers

The Services are provided "as is" and "as available."

To the maximum extent permitted by law, Tap2Check-In disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

33. Limitation of Liability

To the maximum extent permitted by law, Loa Keo LLC, Tap2Check-In, and their owners, officers, employees, contractors, vendors, and service providers will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, including lost profits, lost revenue, lost data, loss of goodwill, message delivery failure, carrier filtering, campaign rejection, account suspension, or regulatory penalties arising from your misuse of the Services.

34. Indemnification

If you use Tap2Check-In as a participating business, you agree to defend, indemnify, and hold harmless Loa Keo LLC, Tap2Check-In, and their owners, officers, employees, contractors, vendors, and service providers from claims, damages, penalties, liabilities, costs, and expenses arising from:

  • your use of the Services;
  • your message content;
  • your customer data;
  • your failure to obtain proper consent;
  • your failure to honor opt-outs;
  • your violation of law;
  • your violation of carrier, ClickSend, Twilio, or platform requirements;
  • your breach of these Terms.

35. Arbitration and Class Action Waiver

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or communications sent through Tap2Check-In shall be resolved by binding arbitration on an individual basis, and not in a class, collective, consolidated, or representative action.

You and Loa Keo LLC each waive the right to participate in a class action or class-wide arbitration.

This section does not prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction where necessary to protect intellectual property, confidential information, security, or service integrity.

36. Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time.

37. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted with a new "Last updated" date. Continued use of the Services after changes means you accept the updated Terms.

38. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
